New Attorney, Jennifer Pitzer, Joins Team

Clayborne and Wagner LLP is pleased to announce that attorney Jennifer Pitzer has joined the firm in the practice area of Personal Injury Litigation.

Prior to joining Clayborne & Wagner, Pitzer spent six years as a law clerk in the Southern District of Illinois with particular emphasis on Section 1983 litigation. Pitzer was also formerly an associate of Hinshaw & Culbertson LLP, where she worked on municipal matters, labor & employment, school law, and toxic torts.

Pitzer received her Juris Doctor Degree in law from the St. Louis University School of Law in 2011. She also served as managing editor for the Saint Louis University Law Journal “Teaching Admiralty” issue. She received a top student award in Civil Procedure 1, Civil Procedure 2, Constitutional Law 1, Constitutional Law 2, and Health Care law.

Corinne Mitchell Joins Team

Clayborne and Wagner LLP is pleased to announce that attorney Corinne Mitchell has joined the firm in the practice area of Personal Injury Litigation and Animal Law. 

Prior to joining Clayborne & Wagner, Mitchell spent two years as a law clerk to the Honorable Judge David R. Herndon in the Southern District of Illinois, with a particular emphasis on mass actions and multi-district litigation.

Prior to clerking, Mitchell served as an associate attorney for HeplerBroom LLC, where she worked exclusively on the complex litigation team, working closely on high-profile toxic tort trials in the city of St. Louis.

Claim of Injuries Struck Down as Aribitrator Favors Employer

An Arbitrator for the Illinois Workers’ Compensation issued a decision in favor of the employer represented by Attorney Jennifer Barbieri. Petitioner, a bakery worker for Respondent, claimed she sustained injuries to her low back during an unwitnessed lifting accident. Petitioner demanded that Respondent authorize surgery for her low back condition, pay almost three (3) years of TTD benefits, and pay disputed medical expenses. Respondent denied the claim with Ms. Barbieri arguing that Petitioner completely failed to prove that she sustained a work-related accident.

The Arbitrator agreed with Ms. Barbieri’s position and the evidence put forth on behalf of the employer in ruling that Petitioner failed to prove that she sustained a work-related accident. Based upon the finding of no accident, all remaining issues including causal connection, liability for unpaid medical bills, temporary total disability, and prospective care were rendered moot. The Arbitrator agreed with Ms. Barbieri’s arguments that the contemporaneous medical record did not support Petitioner’s version of events, as well as the fact that the discrepancies in the timing of the injury, mechanism of injury, and Petitioner’s history were not corroborated in the evidence. Clayborne, Sabo & Wagner to open Chicago location

Majority Partner James Clayborne Jr. announced that Clayborne, Sabo and Wagner LLP will open a Chicago office in February.

The location will be in downtown Chicago near the Cook County Courthouse.  According to Mr. Clayborne the decision to open a Chicago location was driven by requests from the Firm’s clients located in the Chicago and northern Illinois area.  The location of the new office will be made public soon.
